My dad set up a bank acct in trust for my brother,the bank cut a chk to the beneficiary instead -is this legal

If the account was in trust for your brother, your brother WAS the beneficiary. Unless an actual trust doent was created and filed with the appropriate court, the account WAS NOT in trust for anyone. If such a doent was created, the terms of the doent ARE the law in this case.
